Refund, Returns Policy & Terms and Conditions for Starter Website Design Package
These Terms and Conditions govern the provision of website design and associated services by CCwithAI (referred to as “we”, “us”, or “our”) to you (referred to as “you” or “the Client”). By placing an order for our services, you agree to be bound by these Terms and Conditions.
1. Services Provided:
We will provide the website design services as outlined in our initial offer, including the creation of a 4-page website tailored to your brand. This package also includes hosting, initial SEO setup, access to our AI content creation tool, domain name registration (for the first year), a free AI chatbot, and a free SSL certificate, as detailed on our website.
2. Payment Terms:
- The initial payment made at the time of order covers the first 12 months of the 24-month contract.
- The remaining 12 months of the contract must be paid in monthly instalments of £26.25, payable via a standing order mandate that you will set up. £15 domain renewal is spread over the 12 months added to hosting fee.
- Full Payment: You may also choose to pay the full cost upfront via Visa.
- Klarna and Clearpay: We also offer Klarna and Clearpay as payment options at checkout for the initial payment, subject to their respective terms and conditions. Subsequent monthly payments for the second year of the contract will still be required via standing order.
- Late Payment Fees (for monthly standing order payments):
- If a monthly payment is late by 5 working days, a late payment fee of £10 will be applied.
- If a monthly payment is 14 working days overdue, the late payment fee will increase to £25.
- If a monthly payment is 30 days overdue, access to your website and any associated features will be suspended.
- Suspension of Services: We reserve the right to suspend any add-on services or any other accounts you may hold with us if any monthly standing order payment is more than 7 working days late.
3. Website and Domain Ownership:
The website and the domain name(s) associated with it will remain the property of CCwithAI until the initial contract period of 24 months has expired and all outstanding payments have been made in full.
4. Transfer of Ownership:
Upon completion of the 24-month contract and provided all fees have been paid, the website files and domain name(s) can be transferred to you or a third party of your choosing. We will perform the necessary DNS change for a one-time administration fee of £15.
5. Cancellation:
- Cancellation by You: If you wish to cancel your contract before the end of the 24-month period, the remainder of the total contract value will become immediately payable.
- Cancellation by Us (Due to Late Payment): If we cancel your contract due to non-payment and the outstanding balance (including the remainder of the contract value) is not paid within 7 days of cancellation, we reserve the right to initiate legal proceedings to recover the debt, which may negatively affect your credit rating.
6. Design Brief and Website Build:
We will contact you after your order is placed to obtain a design brief. We aim to have your initial website draft ready within 48 hours of receiving a comprehensive design brief. Please note that this timeframe is an estimate and may vary depending on the complexity of your requirements and the responsiveness of your feedback.
7. Website Content:
You are responsible for providing all the necessary content for your website, including text, images, logos, and any other media. You warrant that you have the right to use this content and that it does not infringe upon the intellectual property rights of any third party.
8. Intellectual Property:
While the website design is tailored to your brand, the underlying code, platform, and any proprietary tools developed by us remain the intellectual property of CCwithAI. Upon full transfer of ownership after the 24-month contract, you will have the right to use the website as it exists at that time.
9. Limitation of Liability:
To the maximum extent permitted by law, our liability to you for any loss or damage arising out of or in connection with our services shall be limited to the total fees paid by you for the specific services in question. We shall not be liable for any indirect, consequential, or economic loss.
10. Data Protection:
We will handle any personal data you provide in accordance with the UK General Data Protection Regulation (GDPR) and our Privacy Policy, which is available on our website.
11. Governing Law and Jurisdiction:
